Damages and Compensation

Under the Ontario Human Rights Code, the board of inquiry may order, amongst other things, full and complete compensation to the complainant, including loss of wages or other income from employment. In addition, the board of inquiry may order monetary compensation for mental anguish, in an amount not exceeding $10,000.00.

Under the Canadian Human Rights Act, the tribunal also has the authority to order full and complete compensation including loss of wages, as well as monetary compensation up to $10,000.00 for mental anguish. The tribunal also has the power, in appropriate cases, to award damages in respect of injury to feelings or self-respect up to a maximum amount of $5,000.00.
