Application for Employment

Both the Ontario Human Rights Code and the Canadian Human Rights Act prohibit applications for employment that directly or indirectly suggest or indicate qualifications by a prohibited ground of discrimination. The human rights commissions will prepare and on request provide sample application forms which comply with the provisions of the legislation. They also encourage employers to submit their application forms to them in order to be approved in advance by the Commission. Even requests for information which may provide a way in which to obtain discriminatory information from the applicant can be prohibited. For example, the Ontario Human Rights Commission advises employers not to request drivers license number from job applicants, since an individual's license number contains his or her birth date.
