Discrimination Law

Nationality, Citizenship, Ancestry and Place of Origin

An "ethnic group" has been defined to be a distinct category of the population in society whose culture is usually different from that of the larger society.

Examples of indirect discrimination on the basis of ancestry, place of origin or ethnic origin include the adoption of height and weight requirements by an employer. In certain instances, this will amount to discrimination since it has the affect of excluding certain people of a particular nationality or ethnic origin who tend to be of smaller physical stature. Likewise, requirement of verbal and written facility in the English language could amount to discrimination where verbal and/or written communication in the English language is not considered to be an essential duty of the job.
