Settlement of a Complaint

Any proposed settlement of a complaint filed with the either the Ontario Human Rights Commission or the Canadian Human Rights Commission is subject to the formal approval of the Commission in order for the settlement to be enforceable. Although the human rights commissions typically approve most of the settlement agreements arrived at between the parties, there are instances in which they have withheld such approval. This is because the human rights commissions are not just concerned about the interests and rights of the party to the complaint. Their over-riding concern is with respect to the public interest. They may determine the terms of settlement are inadequate or that the complaint should proceed to a hearing.
