Employment Agencies
Both the Ontario Human Rights Code and the Canadian Human Rights Act prohibit an employer from retaining an employment agency to hire a candidate in a way or in circumstances which would amount to discrimination. In other words, an employer cannot get around the provisions in the human rights legislation which relate to the hiring process by having an employment agency do their work for them. It is an offence for an employer to place such an order with an employment agency. Likewise, it is unlawful for the employment agency to accept such an order.
Employment agencies have come under very careful scrutiny by the Ontario Human Rights Commission in recent years.
