Age Discrimination

The Ontario Human Rights Code provides that every person has a right to equal treatment with respect to employment without discrimination because of age. Age is defined within the legislation as "an age that is 18 years or more and less than 65". Since many employers in Ontario have policies that provide for mandatory retirement of employees at age 65, these companies are not breaching the provisions of the Human Rights Code.

The Canadian Human Rights Act on the other hand, includes no specific limitation on the term "age". It also provides that there is no discrimination if an individual's employment is terminated because that person has reached the "normal age of retirement" for employees working in positions similar to that individual's position.
