Legitimate Occupational Requirements

Under the Ontario Human Rights Code, there is an exemption for discrimination based upon age, sex, record of offenses or marital status where it is a reasonable and legitimate qualification because of the nature of the employment.

An example of a legitimate occupational requirement is where a Roman Catholic school board requires that its teachers be practising members of the Roman Catholic church.
