Forcing the Employer to Correct Certain Things

The most extensive and far reaching powers of human rights tribunals involves their ability to direct certain action to be taken and/or a discontinuation of certain practises or conduct by the employer. It is through the use of this power that human rights tribunals are best able to ensure that the discriminatory practice or conduct will not be continued or repeated in the future.

Examples of the types of mandatory orders that may be made by human rights tribunals include:

  • the implementation of affirmative action programs, either with respect to hiring or promoting individuals who are members of groups requiring protection
  • requiring the employer to adopt or implement a special program, plan or arrangement in the work place
  • requiring the employer to revise their employment records, issue letters of apology and similar types of orders
  • requiring the employer to create educational seminars and programs designed to both educate and eliminate discriminatory actions and
  • conduct in the workplace
