HIV/Aids: Rights and Interests of Co-Workers

An employer cannot rely upon the concerns of co-workers with respect to working with or close proximity to an HIV infected person, even where those concerns are honestly held and genuine. In other words, the employer's duty to accommodate the HIV infected employee will take precedence over the concerns of co-workers in virtually every case.
