Protection Against Retaliation and Reprisal

Both the Ontario Human Rights Code and the Canadian Human Rights Act contain provisions which prohibit any form of retaliation or reprisal against a person who files a complaint or an individual who participates in any way in the human rights investigation and hearing process, including witnesses. A classic example of a reprisal against an individual who filed or threatened to file a human rights complaint, would involve the demotion or termination of that person's employment due, in whole or in part, to their attempting to enforce their rights under the human rights legislation.
