Psychological and Aptitude Testing
Neither the Ontario Human Rights Code nor the Canadian Human Rights Act contain any provisions relating to the propriety of psychological or aptitude testing in the hiring process. However, it can be said that the human rights commissions would be prepared to entertain any complaint involving a form of aptitude or psychological testing which is simply not relevant in determining the ability of the individual to perform the job in question. Many of these aptitude tests are fairly old and tend to include sexist language or discriminate against individuals who are not familiar with Canadian culture.
