Discriminatory Employment Advertising

Employers are prohibited from discriminating, directly or indirectly, by inviting or advertising for employment based on any of the following grounds:

  • race
  • ancestry
  • place of origin
  • colour
  • ethnic origin
  • citizenship
  • creed
  • sex
  • sexual orientation
  • age
  • record of offences
  • marital status
  • family status
  • disability or handicap

Examples of indirect discriminatory employment advertising include:

  1. a request for "waitresses" as opposed to "waiters/waitresses", constitutes discrimination on the basis of sex;
  2. a requirement for "able-bodied persons" amounts to discrimination on the basis of handicap or disability;
  3. a stated request or preference for "Canadian experience" may amount to discrimination on the basis of place of origin or citizenship.
