Misstating Education, Qualifications, and Experience

Most court decisions involving misstatements or misleading information provided by employees at the hiring stage relate to the job candidate's education, qualifications and experience. An employee may be terminated for just cause as a result of misrepresentations made to the employer during pre-employment interviews and discussions.

The courts, in recent years, have emphasized the relationship of trust between an employer and an employee which begins at the point that the employee submits his or her resume to the employer, indirectly vouching for the accuracy of the information submitted to the employer. In many instances, it is difficult to draw the line between the typical "hype" or "sales pitch" made by an employee in the course of job interviews verses misrepresentations which may subsequently support a termination for just cause without notice and without compensation.
