Conflict of Interest

Conflict of interest is one of the more most rapidly developing and complicated areas of just cause for dismissal.

Seeking employment with another company or considering starting one's own business in competition with their employer will not amount to just cause for termination in most cases.

Whether an employer has just cause to terminate an employee in circumstances of a potential conflict of interest will depend, to a very large extent, upon the nature of the employment relationship, the details of the potential conflict and the circumstances surrounding the actions of the employee. Courts have increasingly recognized the very far reaching duties of management and senior level employees to avoid engaging in any conduct which could possibly amount to or be perceived as a potential conflict of interest.
