Developing a Sexual Harassment Policy

It is clearly in the interests of employers and employees alike to strive to eliminate sexual harassment in the workplace. In order to achieve this goal, a carefully considered and drafted sexual harassment policy is mandatory. Perhaps even more important, the absence of a sexual harassment policy can be a very damning piece of evidence against an employer in a hearing before a human rights tribunal.

A comprehensive sexual harassment policy should include:

  • a strong statement of the employer's philosophy concerning sexual harassment
  • a very clear definition of sexual harassment
  • the identification of persons covered by the policy
  • the procedures to be followed in response to sexual harassment complaints
    provisions relating to disciplinary consequences
  • a statement regarding confidentiality

The true test of any sexual harassment policy will lie in its day-to-day application.
