Recently we reviewed the case of a woman assaulted by a cab driver, who had picked her up while in a state of inebriation. The Ontario Court of Appeal upheld the trial decision dismissing the claim against the taxi cab company, refusing to hold the employer responsible based on the principle of vicarious liability. That decision was the subject of an application for leave or permission to appeal to the Supreme Court of Canada. The Supreme Court recently denied the leave application and hence the Court of Appeal decision stands.
