“Reasonable Notice” and Severance Packages

When an employee is terminated, their employer must provide them with either advance notice of that termination, payment in lieu of that notice, or, in some cases, both. This is commonly known as “reasonable notice” or severance.

The workplace parties often disagree about how much notice or payment in lieu of, is appropriate or fair. Legislation such as the Employment Standards Act (ESA) provides for the minimum that an employee is entitled to upon termination, but other factors usually come into play, and, importantly, not all employees are covered by the ESA. Following a termination, negotiations over severance are common.
